GDPR

  1. The administrator of the Personal Data is 123 Ortodoncja Katarzyna Piątek-Jakubek, ul. Marcika 4a lok. I/4, 30-443 Kraków.
  2. You have the right to:
  • obtain confirmation as to whether we are processing your personal data and, if so, to obtain access to such data, after verification of your identity,
  • access to your data and receive a copy of your data, after verification of identity,
  • free of charge of the first copy of the processed data, the issuance of subsequent copies is chargeable,
  • rectification (correction) of your data,
  • the right to be forgotten does not apply to personal data processed on the basis of the article 9(2)(h) GDPR, in particular to the processing of personal data as part of medical records for the entire required archiving period in accordance with the article 29(1) of the Patients’ Rights Act in conjunction with the article 17(3)(b) of the GDPR,
  • where data is processed on the basis of a patient’s consent, you may implement your right to be forgotten to the extent of the purpose specified in that consent,
  • the restriction of processing does not apply to your personal data processed for the purpose of providing medical services, in particular, as part of your medical records, we may process your data to the extent of the existing purpose, as this could significantly impede the purpose,
  • withdraw your consent to the processing of personal data; at any time you may withdraw your consent to the processing of personal data for marketing, educational, scientific, advertising purposes – as long as you have given us such consent in writing; withdrawal of consent will not affect the lawfulness of the processing we performed on the basis of your consent before withdrawal,
  • provide access to your medical records under the terms of articles 26 and 27 of the Act of November 6, 2008 on Patient Rights and Patient Ombudsman (consolidated text: Journal of Laws of 2016, item 186, as amended),
  • lodge a complaint to a supervisory authority; if you believe that we process your personal data unlawfully, you can file a complaint with the President of the Office for Personal Data Protection.

Verification of identity is carried out by checking the proof of identity document presented by you, which contains at least a photograph, name and surname, and PESEL or, if there is no PESEL, another number uniquely identifying the Patient. The document confirming your identity is in particular: identity card, student card, driver’s license, passport. We can record information about the verification by entering in the documentation: the date when the verification of identity was made and the details of the document on the basis of which the verification was made, while indicating the number/identifier of this document (e.g., number and series of identity card).
  2. If a legal representative is acting on behalf of a minor patient, the identity of the patient may also be confirmed by the legal representative by means of a statement and presentation of the legal representative’s identity card. We can record information about the date of the verification and the document of the legal representative on the basis of which it was made.
  3. In order to exercise your rights, please direct your request to the e-mail address rejestracja@123punkt.pl.Please note that before executing your request, we will have to make sure that the request is definitely coming from you, i.e. we will have to identify you by asking for data that only you know. If the verification of your identity is not successful, we will have to ask you to visit our office in person to confirm the request and identify you correctly, only then will your request be subject to processing.
  4. Your provision of personal data is a statutory requirement under §1 and 2 of the Regulation of the Minister of Health of November 9, 2015 on types, scope and models of medical records and the manner of their processing (Journal of Laws of 2015, item 2069), as well as under articles 25 and 24 of the Act of November 6, 2008 on Patients’ Rights and Patients’ Rights Ombudsman (consolidated text: Journal of Laws of 2016, item 186, as amended).
  5. If you do not provide personal information, we will not be able to provide you with treatment services.
  6. Written consent to process personal data for advertising, marketing, educational or scientific purposes is voluntary.
